These Terms of Service (“Terms”) are an agreement between you and CODING SPHERE, the operator of Gymed (“Gymed”, “we”, “us” or “our”). They cover your use of the Gymed mobile app, the Gymed Apple Watch app, the website at gymed.in and related services (together, the “Service”).

1. Accepting These Terms

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and Age

You must be at least 13 years old, or the minimum age required by the law where you live, to use Gymed. If you are under 18 (or the age of majority where you live), you may only use Gymed with the involvement and consent of a parent or legal guardian, who also agrees to these Terms. We do not knowingly collect data from children under 13.

3. Your Account and Sign-In

  • You sign in to Gymed with Google or Sign in with Apple. Your use of those sign-in methods is also governed by Google’s and Apple’s own terms.
  • Please give accurate information (for example your age, weight and fitness goals). Plans and calculations depend on it.
  • Keep your device and sign-in account secure. You are responsible for activity that happens through your account.
  • Tell us right away at ritik@codingsphere.co if you think someone else has accessed your account.

4. Health and Medical Disclaimer — Please Read Carefully

Gymed is not a medical service, and nothing in the Service is medical advice. Workout plans, diet and calorie suggestions, AI Coach responses, and all other content are for general fitness and information purposes only. They do not diagnose, treat, cure or prevent any disease or condition.

  • Talk to a doctor first. Consult a physician or other qualified healthcare professional before you start any exercise programme, change your diet, or rely on calorie or weight targets. This matters most if you are pregnant, have a medical condition, an injury, an eating disorder, or a history of heart, blood-pressure or joint problems, or take medication.
  • Stop if something feels wrong. Stop exercising and seek medical help immediately if you feel pain, dizziness, faintness, shortness of breath or chest discomfort.
  • You assume the risk. Exercise and dietary changes carry a risk of injury, illness and, in rare cases, death. You choose whether to follow any plan or suggestion, and you do so voluntarily and at your own risk.
  • Tracking may be inaccurate. Calorie, weight, workout and Apple Watch measurements are estimates and may not be accurate.
  • Emergencies. Gymed is not for emergencies. If you think you have a medical emergency, contact your local emergency services immediately.

5. AI Coach

Gymed includes an AI Coach chat that can answer questions, generate workout and diet plans, and analyse photos or files you share.

  • Powered by a third party. The AI Coach is powered by OpenAI. When you use it, your messages, any photos or files you attach, and relevant profile and fitness information are sent to OpenAI for processing. We ask for your consent before any data is shared with the AI provider. You can withdraw that consent at any time in Profile, but the AI Coach will not work while consent is withdrawn.
  • AI can be wrong. AI responses are generated automatically and may be inaccurate, incomplete, outdated or unsuitable for you. They are not reviewed by a human or a medical professional. Section 4 applies in full to all AI output.
  • Your judgement. You are responsible for how you use AI output. Check anything important with a qualified professional before acting on it.
  • Be careful what you share. Do not submit information you do not want processed by us and OpenAI. Examples include detailed medical records, government ID numbers, financial information, or other people’s personal data or photos without their permission.
  • Reporting. If the AI Coach produces something harmful, offensive or clearly wrong, please report it to ritik@codingsphere.co so we can investigate.

6. Your Content

“Your Content” means the information you put into Gymed, such as workout logs, weight and calorie entries, chat messages, photos and files.

  • You keep ownership of Your Content.
  • You give us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display Your Content only as needed to operate, maintain and improve the Service for you. This includes sending it to our service providers, such as OpenAI for AI Coach requests. This licence ends when Your Content is deleted, except for copies we must keep by law or that remain for a limited time in backups.
  • You confirm that you have the right to share Your Content and that it does not break any law or anyone else’s rights.

7. Acceptable Use

When using Gymed, you agree not to:

  • break any applicable law, or use the Service for anything unlawful or harmful;
  • upload content that is illegal, sexually explicit, hateful, harassing or violent, or that infringes someone else’s rights;
  • try to make the AI Coach produce harmful content, or to get around its safeguards;
  • reverse engineer, decompile, scrape or interfere with the Service, or try to get unauthorised access to it or its systems;
  • use bots or automated means to access the Service, or overload it;
  • impersonate anyone, or use another person’s account; or
  • resell, sublicense or commercially exploit the Service without our written permission.

8. Intellectual Property

The Service is owned by CODING SPHERE and its licensors. This includes the app, its design, software, exercise library, text, graphics and the Gymed name and logo. These Terms give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial purposes. We reserve all rights we do not expressly grant to you. If you send us feedback or suggestions, we may use them without any obligation to you.

9. Third-Party Services

Gymed relies on third-party services, including Google (sign-in), Apple (Sign in with Apple, App Store, Apple Watch), OpenAI (AI Coach) and Google Firebase (authentication, data storage and related infrastructure). Each of these services has its own terms and privacy policies, and we are not responsible for them. We are not liable for outages or changes to third-party services that affect Gymed.

10. Paid Features

Gymed does not currently charge for any features. If we introduce paid features or subscriptions in the future, we will clearly show the price and terms before you buy. On iOS, in-app purchases and subscriptions will be billed through your Apple ID and governed by Apple’s App Store terms, including Apple’s refund policies.

11. Account Deletion and Termination

  • You can leave at any time. Delete your account in the app under Profile → Delete account. This permanently deletes your account and associated data, and it cannot be undone. Some data may stay in backups for a limited period, or where the law requires us to keep it, as described in our Privacy Policy.
  • We may suspend or terminate access. We may suspend or end your access if you seriously or repeatedly breach these Terms, if the law requires it, or to protect users or the Service. Where reasonable, we will notify you first. We may also change or discontinue all or part of the Service.
  • Sections 4, 5 (AI accuracy), 6 (licences needed to process deletion), 8, 12, 13, 15 and 16 survive termination.

12. Apple App Store Terms

If you downloaded Gymed from the Apple App Store, the following also applies:

  1. These Terms are between you and CODING SPHERE only, not Apple Inc. (“Apple”). CODING SPHERE, not Apple, is solely responsible for the app and its content.
  2. Your licence to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  3. Apple has no obligation to provide any maintenance or support services for the app.
  4. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. CODING SPHERE is responsible for any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty, to the extent those warranties are not disclaimed by these Terms.
  5. CODING SPHERE, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it. This includes: (a) product liability claims; (b) claims that the app fails to meet legal or regulatory requirements; and (c) claims under consumer protection, privacy or similar laws.
  6. If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, CODING SPHERE, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
  7. You confirm that you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  8. You must comply with any applicable third-party terms when using the app.
  9. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

13. Disclaimers and Limitation of Liability

  • “As is”. The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied. These include warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free or secure, or that it will produce any particular fitness, weight or health result.
  • Limitation. To the fullest extent permitted by law, CODING SPHERE and its team will not be liable for any indirect, incidental, special, consequential or punitive damages. This includes loss of data, profits or goodwill, and any personal injury arising from exercise or diet choices you make using the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or INR 1,000.
  • Your legal rights. Some jurisdictions do not allow certain exclusions or limitations. In those places, the above applies only as far as the law allows. Nothing in these Terms limits liability that cannot be limited by law, including your statutory consumer rights.
  • Indemnity. You agree to compensate us for reasonable claims and costs that arise from your breach of these Terms or your misuse of the Service.
  • Events outside our control. We are not liable for delays or failures caused by events beyond our reasonable control.

14. Changes to These Terms

We may update these Terms from time to time. We will post the new version on this page and update the “Last updated” date. If a change is significant, we will give reasonable notice, for example in the app. If you keep using the Service after changes take effect, you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

15. Governing Law and Disputes

These Terms are governed by the laws of India. Subject to any mandatory consumer protection rights you have where you live, the courts at Bathinda, Punjab, India have exclusive jurisdiction over disputes relating to these Terms or the Service. Before you start formal proceedings, please contact us so we can try to resolve the issue informally.

If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right, we have not waived it. You may not transfer these Terms without our consent. We may transfer them as part of a reorganisation or sale of the Service.
